Terms & Conditions

The Unlimited Mixer & Soft Drink Package is an optional enhancement available to guests participating in Pride Afloat: Mission Bay Social Cruise.

By purchasing, accepting, or using this package, guests agree to the following Terms & Conditions.

What's Included

The package may include unlimited access to available onboard:

- Coca-Cola

- Diet Coke

- Sprite

- Club Soda

- Tonic Water

- Sparkling Water

- Ice

- Cups

- Standard drink garnishes

- Other designated soft drinks or mixers

Available items may vary by cruise and are subject to availability.

What's Not Included

The package does not include:

- Alcoholic beverages (BYOB only)

- Bottled water

- Energy drinks

- Snacks or food items

- Merchandise

- Premium beverages

- Specialty cocktail mixers

Examples of excluded specialty mixers include:

- Bloody Mary Mix

- Margarita Mix

- Piña Colada Mix

- Mojito Mix

- Mai Tai Mix

- Specialty juices

- Other prepared or premium cocktail mixers

Keener Adventures LLC reserves the right to determine which products are included in the package.

Party Purchase Requirement

To help ensure fair service and simplify onboard operations, guests purchasing the Unlimited Mixer & Soft Drink Package before departure must purchase the package for all guests included on the reservation.

Availability

All package items are offered on a "while supplies last" basis.

Due to vessel storage limitations, vendor availability, operational requirements, and inventory constraints:

- Certain items may not be stocked on every cruise.

- Certain items may become unavailable during the cruise.

- Certain items may be substituted without prior notice.

No guarantee is made regarding the availability of any specific beverage, mixer, garnish, or package item.

No Refunds or Credits for Inventory Availability

No refunds, credits, discounts, exchanges, or compensation will be provided if:

- A specific beverage is unavailable.

- An included item is unavailable.

- Inventory is depleted during the cruise.

- Certain package items are not offered on a particular departure.

- A guest does not fully utilize package benefits.

The package provides access to available included items while supplies last and has no cash value.

Cruise-Specific Use Only

The Unlimited Mixer & Soft Drink Package is valid only for the specific cruise for which it was purchased.

The package:

- Cannot be transferred to another cruise.

- Cannot be used on a later departure.

- Cannot be carried over to another cruise occurring on the same day.

- Cannot be transferred to another guest.

- Has no cash value.

Unused package benefits expire immediately at the conclusion of the scheduled cruise.

Purchase Deadlines

Advance Purchase

Guests may purchase the package online at the discounted advance-purchase rate until 11:59 PM on the day before departure.

Onboard Purchase

Guests may purchase the package onboard at the posted onboard rate until 30 minutes after departure.

Package sales may be discontinued earlier or later at the sole discretion of Keener Adventures LLC.

Sharing Prohibited

Package benefits are intended solely for the guest to whom the package is assigned.

Items obtained through the package may not be:

- Shared with another guest.

- Distributed to another passenger.

- Obtained on behalf of another guest.

- Stockpiled for later use.

- Exchanged for other products.

This restriction applies regardless of whether another guest has also purchased the Unlimited Mixer & Soft Drink Package.

Each package holder must personally obtain and consume beverages through their own package benefits.

Responsible Use

Guests agree to use the package responsibly and in good faith.

Examples of prohibited misuse include:

- Excessive waste of beverages.

- Excessive waste of mixers.

- Excessive waste of ice or garnishes.

- Repeatedly obtaining beverages for others.

- Misrepresenting package eligibility.

- Circumventing package rules.

- Creating unnecessary operational disruptions.

Suspension or Revocation of Package Privileges

The Captain, crew, and authorized representatives of Keener Adventures LLC reserve the right to suspend, restrict, or revoke package privileges without refund if they determine, in their sole discretion, that a guest has:

- Become excessively intoxicated.

- Created a safety concern.

- Shared package items with other guests.

- Attempted to obtain package items for non-package holders.

- Wasted beverages, mixers, ice, garnishes, cups, or supplies.

- Provided false or misleading information.

- Violated event policies.

- Failed to comply with crew instructions.

- Engaged in conduct that negatively impacts the experience of other guests.

- Created an actual or potential hazard to themselves, other guests, crew members, or vessel operations.

Suspension or revocation of package privileges shall not entitle the guest to any refund, credit, discount, or compensation.

Captain's Authority

The Captain maintains final authority regarding all vessel operations, passenger safety, onboard service, package eligibility, inventory management, and conduct-related matters.

All decisions made by the Captain regarding package administration and safety shall be final.

California Legal Notice

These Terms & Conditions are intended to establish guest expectations, service policies, package limitations, operational procedures, and onboard conduct requirements for participants in Pride Afloat: Mission Bay Social Cruise.

Because this activity occurs in California and involves recreational boating, passenger vessel operations, alcohol-related policies, and optional beverage package sales, Keener Adventures LLC recommends periodic review of these Terms & Conditions by a licensed California attorney familiar with hospitality, recreation, maritime, and consumer protection laws.

Keener Adventures LLC reserves the right to update, modify, suspend, or discontinue the Unlimited Mixer & Soft Drink Package, associated pricing, included items, and these Terms & Conditions at any time to comply with:

- Federal, state, and local laws

- California consumer protection requirements

- United States Coast Guard regulations

- Insurance carrier requirements

- Marina or venue requirements

- Safety considerations

- Operational needs

Any modification shall apply prospectively and shall not affect rights already granted under applicable law.

Acknowledgment

By purchasing, accepting, or using the Unlimited Mixer & Soft Drink Package, the guest acknowledges that they have read, understood, and agreed to these Terms & Conditions and agree to comply with all crew instructions, safety requirements, and package rules.
